Government

 

The Republic of Armenia is a sovereign, democratic, social, rule of law state. The state power is administered pursuant to the Constitution and the laws based on the principle of separation of the legislative, executive and judicial branches. The Constitution was adopted on July 5, 1995, through a popular referendum and amended by referendum on 27 November, 2005.

 
The President 

 
Armenia is a republic with a presidential governing system. The president is the head of state. In accordance with the Constitution, the President ensures compliance with the Constitution, the normal operation of the legislative, the executive and the judiciary, and serves as the guarantor of sovereignty, territorial integrity and security of the Republic.

The President is elected directly by the citizens of the Republic of Armenia for a five-year term. The same person cannot hold the office of president for more than two consecutive terms.

The first president of the Republic of Armenia, Levon Ter-Petrossyan, was elected on October 16, 1991, and re-elected in 1996. When he resigned in 1998, the then Prime Minister Robert Kocharyan was elected President of the Republic of Armenia on March 30, 1998.  On March 5, 2003 Robert Kocharyan was re-elected President for the second term. On February 19, 2008 Prime Minister Serge Sarkissyan was elected Armenia's 3rd Presidence since the independence.

The Legislature

Legislative power in the Republic of Armenia are vested in the National Assembly (Parliament), which implements its activities through sessions, permanent and temporary committees. The National Assembly is a single-chamber representative body. Its members are elected by a combination of majority district and proportional (party-list) representation.

The last parliamentary elections were held on May 12, 2007. 131 deputies (Members of Parliament) were elected, 56 were elected through the majoritarian electoral system and 75 deputies were elected through the proportional representation system. The proportional representation system provides for seats for political parties and political blocs who can pass the 5% threshold of the popular vote.

The National Assembly is convened twice a year: in spring (from the first Monday of February to the second Wednesday of June) and autumn (from the second Monday of September to the second Wednesday of December). Extraordinary sessions may be convened by the President of the Republic at the initiative of the Government, or at least one third of the total number of deputies; and by the Chairman of the National Assembly at the initiative of the Government or at least one third of the total number of deputies.

The Chairman of the National Assembly is elected by a majority of votes in a secret ballot by the Members of Parliament.

The Executive 

The executive power in the Republic of Armenia is carried out by the Government of the Republic. The Government is composed of the Prime Minister and the Ministers. The President of the Republic appoints and removes the Prime Minister of the Republic. The President also appoints and removes all members of the Government nominated by the Prime Minister.  The structure and procedures of the activities of the Government are defined by a decree of the RoA President upon presentation by the Prime Minister.

The Judiciary


In the Republic of Armenia justice is administered solely by the courts in accordance with the Constitution and the laws. The courts operating in the Republic of Armenia are the first instance court of general jurisdiction, the courts of appeal, the Court of Cassation, as well as specialized courts in cases prescribed by the law. The highest court instance in the Republic of Armenia, except for matters of constitutional justice, is the Court of Cassation, which ensures uniformity in the implementation of the law. The Constitutional Court administers constitutional justice in the Republic of Armenia. The independence of courts isguaranteed by the Constitution and laws. The Constitution and the lawdefine the procedure for the formation and activities of the Council of Justice. The Office of the Prosecutor General in the Republic of Armenia represents a unified, centralized system, headed by the Prosecutor General. The Office of the Prosecutor General operates within the powers granted by the Constitution and on the basis of the law.
